Election law advice

Increase voter turnout through an innovative program

Background & Context

This is a a "bleeding-edge" voter turnout program that we cannot run until we are able to ensure that we are in compliance with applicable statutes.

We'd like to understand exactly what we're able to do / not do as it relates to this innovative program.

Work & Deliverables

Hub3 supports "Ambassador Program," which is intended to increase the health, wealth and power in communities of color. The program selects individuals in the local community to serve as Community Ambassadors and Voting Ambassadors. A Community Ambassador watches videos on basic topics (e.g., how to open a bank account, how to prepare a will, how to register to vote, etc.), and then recruits others in the community to do the same. Each recruit is encouraged to identify three friends, relatives or acquaintances to view the videos. During election years a Community Ambassador may be selected to also be a Voting Ambassador.

A Voting Ambassador develops a plan to vote and recruits other people in the community to do the same. Each person recruited by the Voting Ambassador (a Voting Tripler) develops his or her own plan to vote and identifies three friends, relatives or acquaintances eligible to vote who are encouraged to develop their own plans to vote. Members of a Voting Tripler network are reminded periodically of their voting plans for upcoming elections.

Compensation of Ambassadors
Ambassadors may be paid for their efforts. Payment depends on fulfillment of one or more of the following contingencies currently being considered by Hub3: (1) a Community Ambassador registers to vote and recruits a Community Tripler to register to vote, (2) a Voting Ambassador develops a plan to vote and recruits a Voting Tripler, (3) the Voting Tripler develops a plan to vote and identifies three voters, and/or (4) each voter identified by the Voting Tripler develops a plan to vote.

Compensation arrangements for Community Ambassadors are under discussion. Compensation for Voting Ambassadors is approximately $20 for establishing each Voting Tripler network. Payment depends on whether the possible contingencies listed above are fulfilled. Payment does not depend on whether the Voting Tripler or the people in the Voting Tripler’s network promise
to vote or actually vote.

Questions

Are any of the four stated payment contingencies problematic under federal election law?
Are they problematic under Texas, Florida, Georgia and North Carolina state law?
Can the program be operated to support particular issues or candidates?
